These Terms of Use (“Terms”) govern your participation in ASBA’s text messaging programs and your use of any related webpages or sign-up forms (collectively, the “Service”). By opting in to receive text messages from ASBA, you agree to these Terms and our Text Messaging Privacy Policy.
Acceptable Use
You agree not to misuse the Service and to use it only in compliance with applicable laws. You will not use the Service in any way that is illegal, fraudulent, harmful, or that could interfere with or disrupt the Service. ASBA may restrict or terminate access to the Service at any time, at our discretion.
SMS Program Terms
- Consent & Eligibility: By providing your mobile number and opting in, you consent to receive recurring texts from ASBA. You represent that you are the account holder (or have the account holder’s permission) and are 18+ (or have parental/guardian consent if 13–17).
- Message Types & Frequency: Messages may include event reminders, ASBA updates and other relevant communications. Frequency varies.
- Cost: Message and data rates may apply.
- Opt-Out: Text STOP to end all messages. You may also opt out via the contact method listed below.
- Help: Text HELP for help.
- Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages. Delivery is subject to your carrier’s network and device capabilities.
- Number Changes: If you change, deactivate, or reassign your number, you agree to notify ASBA promptly to prevent messages from being sent to someone else.
- Availability: The Service is provided “as available.” ASBA does not guarantee any specific availability window or delivery timing.
Accounts & Access
Some ASBA webpages or resources may require a login. You are responsible for safeguarding your credentials and for all activity under your account.
Intellectual Property
All content made available by ASBA through the Service (including texts, webpages, graphics, logos and materials) is protected by copyright and other intellectual property laws. You may view and print materials for personal, non-commercial, or educational use only. You may not copy, republish, sell, sublicense, publicly display, distribute, or otherwise exploit ASBA content without prior written permission.
Trademarks
ASBA names, logos and marks are trademarks or service marks of the Arizona School Boards Association. You may not use ASBA marks without our prior written consent.
Links to Third Parties
Messages may include links to third-party websites. ASBA does not control, endorse, or assume responsibility for third-party content, policies, or practices. Review their terms and privacy policies before engaging.

Information shared via the Service is for general informational purposes only and is not legal advice. Participation in the Service does not create an attorney-client relationship.
Disclaimer of Warranties
THE SERVICE AND ALL RELATED CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” ASBA MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or free from viruses.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASBA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY EXISTS, ASBA’S TOTAL LIABILITY WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Indemnification
You agree to indemnify, defend and hold harmless ASBA and its officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable attorneys’ fees) arising from your use of the Service or any violation of these Terms.
Changes to the Terms
ASBA may update these Terms at any time. Updates will be posted to this page with a revised “Last updated” date. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
Governing Law & Venue
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of state and federal courts located in Maricopa County, Arizona for any disputes arising out of or relating to the Service or these Terms.
